Contractul individual de munc\u0103 men\u021biona c\u0103 diurna se stabile\u0219te \u00eentre 35 \u0219i 80 Euro\/zi, ulterior fiind modificat\u0103 \u00een sensul stipul\u0103rii unui minim de 65 euro pe zi.<\/p>\n\n\n\n<p> \u00cen ceea ce prive\u0219te diferen\u021ba de 15 Euro\/zi solicitat\u0103 de reclamant, instan\u021ba a considerat c\u0103 aceasta nu are fundament, deoarece de\u0219i, potrivit art. 272 Codul muncii, sarcina probei \u00een conflictele de munc\u0103 revine angajatorului, \u00een ipoteza dat\u0103 p\u00e2r\u00e2ta, prin avoca\u021bii Brisc Legal specializa\u021bi \u00een conflicte de dreptul muncii, a dovedit c\u0103 a achitat diurna conform contractului \u0219i actelor adi\u021bionale, astfel c\u0103 reclamantului \u00eei revenea obliga\u021bia de a dovedi temeinicia preten\u021biei reprezent\u00e2nd diferen\u021b\u0103 de diurn\u0103.<\/p>\n\n\n\n<h2 class=\"gb-headline gb-headline-82140ada gb-headline-text\"><strong>Argumentele prezentate de c\u0103tre avoca\u021bii specializa\u021bi \u00een litigii de dreptul muncii<\/strong><\/h2>\n\n\n\n<p>Reclamantul a sus\u021binut c\u0103 a primit doar par\u021bial \u00eendemniza\u021bia de delegare (diurna) \u0219i a solicitat achitarea \u00een integralitate a restan\u021belor financiare.<\/p>\n\n\n\n<p>Legisla\u021bia \u00een vigoare stabile\u0219te \u00een sarcina angajatorilor obliga\u021bia de a acorda salaria\u021bilor care desf\u0103\u0219oar\u0103 activitate transna\u021bional\u0103 o sum\u0103 de bani, denumit\u0103 diurn\u0103 ori indemniza\u021bia de delegare\/deta\u0219are transna\u021bional\u0103. Aceast\u0103 sum\u0103 de bani are rolul de a compensa inconvenientele cauzate de delegarea\/deta\u0219area transna\u021bional\u0103, care constau \u00een \u00eendep\u0103rtarea salariatului din mediul s\u0103u obi\u0219nuit.
